These Terms of Use (“Terms”) govern your use of OPN2IT, an adults-only social discovery service operated by KASIVELA (“OPN2IT,” “we,” “us,” or “our”).
By creating an account or using OPN2IT, you agree to these Terms and the Community Guidelines.
1. Eligibility
You may use OPN2IT only if you are at least 18 years old, are legally capable of entering into these Terms, and your use of OPN2IT is lawful where you live and where you use the service.
2. One Account Represents One Presence
An OPN2IT account represents one profile and one presence in the service.
A Couple account represents the couple as one OPN2IT profile.
If either partner wants to operate an independent Woman or Man profile separately, that person must establish a separate OPN2IT account and, where applicable, a separate membership.
Users may not sell, transfer, rent, or provide unauthorized access to their accounts.
3. Account and Profile Information
You agree to provide substantially accurate information and to keep your profile reasonably current.
You may not impersonate another person or knowingly misrepresent who is participating in your profile.
4. Adults Only
No person under 18 may use OPN2IT.
Members may not create profiles for minors, depict minors in sexual contexts, solicit minors, attempt to contact minors through OPN2IT, or upload content involving sexual exploitation of minors.
Suspected exploitation may be reported to appropriate authorities where required or appropriate.
5. Consent and Personal Boundaries
Participation in OPN2IT never constitutes consent to sexual contact, physical contact, or any activity outside the app.
A Wave is not consent. A match is not consent. A message is not consent. A Tonight preference is not consent. Previous activity or communication is not continuing consent.
Consent must be freely given, current, and may be withdrawn at any time.
6. Real-World Meetings
OPN2IT helps adults discover and communicate with other adults. OPN2IT does not control members’ conduct outside the service.
You are responsible for deciding whether, when, and where to meet another person.
OPN2IT does not guarantee another member’s identity, intentions, the accuracy of information supplied by another member, another member’s safety or conduct, or that a meeting or interaction will occur or be successful.
Unless OPN2IT expressly states otherwise, OPN2IT does not perform criminal-background checks or independently verify every statement made by members.
Members should exercise appropriate judgment when meeting another person.
7. Prohibited Conduct
You may not use OPN2IT to threaten, stalk, harass, bully, or intimidate another person; engage in non-consensual sexual behavior; pressure or coerce another person; impersonate another person; publish another person’s private information without permission; distribute intimate images without consent; exploit, traffic, abuse, or coerce another person; facilitate prostitution, commercial sexual services, or unlawful transactions; solicit minors; upload prohibited explicit imagery; engage in fraud, scams, deceptive commercial activity, or financial solicitation; distribute malware or attempt unauthorized system access; evade blocks, bans, or enforcement actions; or use OPN2IT for illegal activity.
8. Member Content
You retain ownership of content you create.
By submitting content to OPN2IT, you grant KASIVELA a limited, non-exclusive license to host, process, reproduce, transmit, and display that content only as reasonably necessary to operate, secure, moderate, support, and provide OPN2IT.
This license does not transfer ownership of your photographs, messages, or other content to OPN2IT.
You represent that you have the rights necessary to upload and share content you submit.
9. Live Snapshot Rules and Content Moderation
OPN2IT does not require permanent profile photos. When you choose to Go Live, you must take one fresh Live Snapshot for that active Live session. You may replace it while Live. OPN2IT deletes the previous Snapshot when it is replaced and deletes the current Snapshot from OPN2IT when the Live session ends.
Live Snapshots must comply with the Community Guidelines. OPN2IT does not certify who is depicted in a Live Snapshot, and other members decide whether a Snapshot gives them enough information to interact.
Nudity, exposed genitals, sexual activity, and pornographic imagery are prohibited.
OPN2IT may review, restrict, remove, or decline to publish content that violates these Terms, the Community Guidelines, applicable law, or platform requirements.
OPN2IT may use automated moderation technologies and human review.
OPN2IT cannot prevent another person from using device-level screenshot or capture capabilities to copy content displayed on that person’s device.
10. Reports, Blocks, and Enforcement
Members may report prohibited content or conduct and block other members.
OPN2IT may investigate reports and may warn, restrict, suspend, or terminate accounts.
OPN2IT is not required to disclose internal moderation decisions, reporting identities, or investigative information except where required by law.
11. Memberships and Subscriptions
OPN2IT may offer paid subscriptions or other forms of access.
Subscriptions purchased through the Apple App Store are billed and managed through your Apple account and are subject to applicable Apple subscription terms.
OPN2IT does not directly store full payment-card credentials for App Store purchases.
12. No Guarantee of Availability
OPN2IT does not guarantee that another compatible member will be Live, available, interested, or present in any particular location or at any particular time.
13. Service Availability
OPN2IT may modify, suspend, interrupt, or discontinue part or all of the service for maintenance, security, legal, business, or technical reasons.
We do not guarantee uninterrupted or error-free availability.
14. Disclaimer
OPN2IT provides a platform for adults to discover and communicate with one another.
OPN2IT cannot control every member or guarantee the accuracy, safety, legality, identity, intentions, or outcome of interactions between members.
Use of OPN2IT and decisions to communicate with or meet another member involve personal judgment and risk.
To the fullest extent permitted by applicable law, the service is provided on an “as is” and “as available” basis.
15. Limitation of Liability
To the fullest extent permitted by applicable law, KASIVELA and its owners, affiliates, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of OPN2IT.
Nothing in these Terms limits liability where such limitation is prohibited by law.
16. Indemnification
To the extent permitted by law, you agree to be responsible for claims, losses, liabilities, and expenses arising from your unlawful conduct, your violation of these Terms, your violation of the Community Guidelines, or your violation of another person’s rights.
17. Account Suspension and Termination
You may stop using OPN2IT and may delete your account through the account-deletion process when enabled for production.
OPN2IT may suspend or terminate accounts for violation of these Terms, violation of the Community Guidelines, safety or security concerns, fraud or abuse, legal requirements, or conduct that creates material risk to OPN2IT or other members.
18. Changes to These Terms
We may update these Terms as OPN2IT evolves.
When changes are material, we may provide notice within the app and, where required, ask members to review or accept the updated Terms.
